Terms of Service

1. Acceptance of terms

By using the Paczesny Analytics service (the "Service"), you accept these Terms of Service. If you do not agree with any of the provisions, do not use the Service.

2. Description of service

The Service is a web analytics tool that works without cookies, offering, among other things, traffic statistics, heatmaps, user journeys, funnels, Site Health metrics and, optionally, integration with Google Search Console.

3. Account

An account is required to use most features. You are responsible for the confidentiality of your login credentials and for the actions performed on your account. We recommend enabling two-factor authentication (MFA).

4. Acceptable use

You undertake that:

  • you will connect and analyze only sites you have the right to,
  • you will connect only those Google Search Console properties of which you are a verified owner,
  • you will not use the Service unlawfully or attempt to disrupt its operation or security.

5. Third-party integrations

Use of the Google integration is additionally subject to Google's terms (including the Google APIs Terms of Service). The access scope is limited to reading Search Console data and is described in the Privacy Policy.

6. Availability and no warranty

The Service is provided "as is", without warranty of uninterrupted availability. We make efforts to maintain continuity of operation, but we do not provide a formal SLA. Data from external services (e.g. Google) may be delayed or unavailable independently of us. We do not warrant that the Service meets your specific requirements, including any specific legal requirements applicable to your use of it.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect damages, loss of data or profits arising from the use or inability to use the Service. Our total liability arising out of or related to the Service, in aggregate, is limited to the fees you paid us in the three months preceding the event giving rise to the claim; if you have paid no fees, our aggregate liability is zero. This limitation does not apply to liability that cannot be limited or excluded under applicable law, and it applies in addition to, not instead of, our exclusion of indirect and consequential damages stated above.

8. Suspension and termination

You may delete your account at any time. We may suspend or terminate access in the event of a breach of these Terms of Service.

9. Changes to the Terms of Service

We may update the Terms of Service; we signal significant changes with the "Last updated" date at the top of the page. Continued use of the Service after a change constitutes acceptance of it.

10. Governing law and contact

These Terms of Service are governed by Polish law. For matters concerning the Service, write to bartek@paczesny.pl. Any dispute arising from these Terms is resolved by the Polish courts having territorial jurisdiction over the Service operator's address stated in the Imprint. Nothing in these Terms affects any mandatory consumer-protection rights you may have under the law of your place of residence.

11. Data processing and privacy

How we process personal data is described in our Privacy Policy, and the third parties that process data on our behalf are listed at /sub-processors. When you connect Google Search Console, we act as a processor of that data on your behalf under our Data Processing Agreement. Data-subject requests are handled through a single channel: bartek@paczesny.pl.

12. Customer responsibilities

Alongside our own obligations, you are responsible for the following when using the Service:

  • Lawful use: the same commitment you made in the Acceptable Use section above, including connecting only sites and Google Search Console properties you have the right to.
  • Your own privacy policy: maintaining a privacy policy for your own sites that accurately describes your own use of the Service and any cookies or tracking on your site, separate from ours.
  • Your own jurisdiction: deciding for yourself whether your use of the Service requires visitor consent in the jurisdictions where your visitors are located, since consent requirements differ by jurisdiction.
  • Account security: the same credential and MFA responsibilities described in the Account section above, including keeping your login credentials confidential.

13. Controlling language

This Terms of Service is published in English and Polish. In the event of any discrepancy between the two versions, the Polish version prevails; the English version is provided as a courtesy translation.
